How the hell does it fall under the Americans w/ disability act?

He is able to walk to his car, drive to White castle and order his food. Now if there wasnt a wheelchair ramp or they wouldnt let blind people with seeing eye dogs in, then there would be a valid case.


Eating fast food by the truckload and becoming a fatty doesnt count as disabled.


Does NY have loser pays in regards to lawsuits like this?

If the intention of this thread is to argue that this is why we should get rid of ADA, I would point out that any law can be abused by a dumbass. And I'm not sure exactly what we can do about that.

I mean, if you try to re-write ADA to keep someone like this lardass idiot from suing because he's too goddam fat to fit in a booth at White Castle, you run the risk of hampering the ability of ADA to protect those truly facing discrimination.

this is ridiculous. if you are too fat to sit then maybe you are just too fat period and need to lose weight? we cant make everyone comfortable especially when being fat is 99.9% of the time your own fault. Eating disorders, thyroid problems, diabetes, and many other diseases that can help cause people to gain weight still shouldnt be blamed. Being fat is still for the most part laziness and eating the wrong foods and eating too much. all the health issues might make it harder to lose weight but not impossible. so fat people imho should never get special treatment. if your too fat to fly buy 2 seats or lose weight. cant fit in a fast food seating booth then lose weight or go eat somewhere else. being fat should never be put on the same level of other real diseases. when a smoker gets lung cancer its their own fault, when your fat its the same thing everything that happens to your health is your own fault.

The best part is, they have chairs that the fat fuck can sit on. He just HAS to sit in a booth. Lawsuits like this shouldnt even see the light of day. Judges should have the power to throw them the fuck out immediately based on how ridiculous they are. And if your case is thrown out you should have to pay a fine for wasting the courts time.

The man said he was sent drawings of new, larger booths the chain said they were going to put in, but two and half years after he complained, they had still failed to do so.

The man says that the failure to accommodate his needs violate the civil rights of overweight people. He says that the Americans with Disabilities Act is "applicable, not only to me, but to pregnant women and handicapped people." The man says he has no problems sitting down at other restaurants or onboard aircraft.


While the lawsuit is obviously ridiculous, if the part that I bolded above is true then shame on White Castle and I have no sympathy for them. They should have told him to go fuck himself from the very beginning instead they tried to appease this guy and string him along, going so far as sending him drawings and blueprints! When's the last time a store remodeled in your neighborhood and sent you their blueprints to make sure they met your personal approval? If that's the case then he certainly did have a reasonable expectation that changes were going to be made.

Don't get me wrong, I don't think he should expect or deserves to get anything. But White Castle brought this shit on themselves. This is no different that a media outlet or advertisers responding to a handful of nuts who write an angry letter because someone let the f-word slip on a live broadcast or some chick who got her tits cut off wants to dance as a man on some shitty show.

I still can't comprehend seeing no difference between someone with a broken leg that will heal within a few months and someone who has a lifetime disability. It doesn't really matter because they just aren't covered under the ADA:

I dont think the problem is with the law more so then who it actually covers. No, I dont feel the ada covers fat people. I also dont think it covers someone with a broken leg.....or stitches in their foot...or a runny nose.

Bottom line, the ADA shouldnt cover this fat fuck not being able to fit in a booth, especially when there are chairs in the restaurant that he can sit in.
