i know my coworker totally wants the death penalty for her son's murderer. i know ive mentioned her before and how the arresting officer was dirty. they have the man on tape killing the her son. the guy will get out when he's 50. My coworker so upset about it. The part that pisses her off the most: her son's murderer will still have a chance to live some kind of life after he does his 22 years.

Today I realized that there is no ideological difference between the firing of Joe Paterno and the firing of Brett Ratner (or ire over Tracy Morgan, Don Imus, Michael Richards etc) but people are having massively different reactions to it.

Paterno did what was legally required of him and what he felt was dictated by his job description, he isn't the PSU spokesman for legal matters and I'm sure they would never choose him to be the direct contact with a police investigation. A guy like Tracy Morgan did nothing illegal in his stand up and he felt he was fulfilling his job description as comedian.

I always understood that the argument on why it's dangerous to attack people over unpopular speech is the ideological championing of personal freedom. We may morally object to Paterno's perceived lack of action (I think the story is outpacing the facts right now) but he did everything demanded of him by law, and the fallout comes from the gap between what is popularly expected of him. What good is an ideology when it fails in the most extreme cases? I'm not naive, I know the damage of words does not compare to the damage this can cause, but doesn't the failing of our sense of personal freedom when tested so extremely point out how subjective our attitudes are? When you admit that the attitude is subjective, when you're forced to see that there are scenarios where you will abandon the importance of personal freedom, can you act like there is such a thing as overreaction? It all just winds up being subjective, and what you're really saying is majority rules.

I hope I believe in free speech as an ideology. I've never yet met something I thought 'he shouldn't be allowed to say that.' But even saying 'he shouldn't be allowed to say that' is protected by free speech, and if you can convince a private institution to fire Brett Ratner for saying 'fag' I think that's a consequence you agree to in order to exercise your freedom. It seems like we are very willing to sacrifice the personal freedoms of others to protect our own, with no sense of irony.

We may morally object to Paterno's perceived lack of action (I think the story is outpacing the facts right now) but he did everything demanded of him by law, and the fallout comes from the gap between what is popularly expected of him. What good is an ideology when it fails in the most extreme cases? I'm not naive, I know the damage of words does not compare to the damage this can cause, but doesn't the failing of our sense of personal freedom when tested so extremely point out how subjective our attitudes are? When you admit that the attitude is subjective, when you're forced to see that there are scenarios where you will abandon the importance of personal freedom, can you act like there is such a thing as overreaction? It all just winds up being subjective, and what you're really saying is majority rules.

I hope I believe in free speech as an ideology. I've never yet met something I thought 'he shouldn't be allowed to say that.' But even saying 'he shouldn't be allowed to say that' is protected by free speech, and if you can convince a private institution to fire Brett Ratner for saying 'fag' I think that's a consequence you agree to in order to exercise your freedom. It seems like we are very willing to sacrifice the personal freedoms of others to protect our own, with no sense of irony.

I think ALL of the "offending word" brouhahas ( Rattner, Morgan,Imus, etc) to be bullshit, as the first amendment gives you the right to offend.Unfortunately, the special interest groups slide around that by tarring people in the media , basically forcing those spineless corporations to fire or ostracize those people.
Still. the reason Paterno allowed a child rapist to walk around campus was
1. Because he was a 30 yr old friend
2. Joe Paterno thinks he can do whatever the fuck he wants at Penn State . His press conference saying "I'll retire at the end of the year " confirmed that . Unfortunately for Joe, NOBODY else can let child rape slide .If it was a cheating scandal , or payola, he would have been allowed to retire at year's end . If he had come out on Wed and said, "I was wrong to not do more;I'm resigning", he might have possibly saved his legend .Not now

What I meant was neither man's action was illegal. Joe Pa just had to tell his superior which he did, and it isn't illegal to say 'fag.' I do recognize that child abuse is illegal.

I understand that. Paterno's own actions may have been illegal. The rules of the company you work for do not supersede the laws of the land.

I'm going off of what I heard on NPR, that legally Paterno is only compelled to report it internally. If anyone was legally liable I'd think it was the grad assistant, who was the actual witness. Paterno only heard a report, plus he testified in front of a grand jury about it already, I'm sure his lawyers would've had him pleading the 5th if not going to the police in his position was criminal.

Further, John Corbett made a statement that Paterno's actions were a moral shortcoming, but made no mention of legality either.

Again, I think everyone who did not go to the police was wrong here. But that wasn't my point and that's not what I'm arguing about. What I am saying ties more into what I bolded, you're not so offended by the Rattner thing that you think any kind of reaction is justified. But that's just your own taste, because the Paterno thing does disgust you and you think the action was appropriate. In doing that you say people aren't entitled to their own taste, they're just entitled to your taste. If it were some objective rule we were all following then if it violates the rule we know the person is wrong, if it doesn't violate the rule then we dont open our mouths. That's how the law works, Rattner doesn't break the law by saying 'fag', from what I understand Paterno doesn't break the law not going ot the police. That's objective, it works the same for everyone, you cant argue about it. But we're letting our moral laws come in here, and they're totally subjective. With a subjective law like this you can either allow for all possibilities or choose one perspective as superior, which lends itself to inequality.

Noone is trying to stop Rattner from saying 'fag' legally, but they are exercising their right to demonstrate by boycotting or protesting or whatever. And the businesses in the wake also have the freedom to stick with him or cut him to protect themselves financially. The reason why this isn't inequality is because everyone gets their say and then the market decides. But if someone is offended by Rattner saying fag and they want to protest but cant because the majority sensibility doesn't allow it, that's limiting one person's free speech to advance someone elses. That doesn't make any sense.
