The best comparison I can think of would be a group of guys standing around talking and bitching about the boss and one of them records it and takes it to the boss.

The company doesn't dictate the first amendment any more than their dress code isn't dictating your first amendment and your work hours aren't imprisonment. The company makes you sign an agreement, if you dont agree to it you shouldn't sign it, not violate the agreement and then bitch about it how you only signed it because it wasn't fair and you didn't expect anyone to call you on it.
